A Florida woman is suing Hershey for $5 million after she alleged the company “duped” her with “deceptive” packaging for seasonal Reese's chocolates.
Cynthia Kelly of Tampa claims that shapes of chocolates shown on packages, including pumpkins, ghosts, footballs, bats, snowmen and candy bars, do not match the products.
“Hershey's product labels were materially misleading and many consumers were deceived and misled by the images on the product packaging,” Hershey wrote in court documents seen by the New York Post.
After buying pumpkin-shaped chocolates, the American decided to pursue the business. She said she was disappointed not to see eyes and mouths carved into the chocolates as shown on the packaging. She also added that she would not buy the product sold at US$4.49 if the label details were not available.
The class action, if successful, would “affect all consumers who purchased any products in Florida.
