Following the defeat in (Quebec) court, the Legalt government finally agreed to exempt the homeless from the curfew.
On Twitter on Wednesday morning, Health and Social Services Minister Lionel Garment announced that the government would not challenge the decision of the Superior Court, which, the day before, suspended the curfew application for asylum seekers. “The government will amend the decree to exempt the homeless from the curfew,” he said.
For the Liberal representative in this case, a member of the Baurassa-Save Paul Rabbitail, Quebec should not wait for a court decision to review her position. “The CAQ government, disconnected from the reality of homelessness, has received an urgent verdict from the CSQ, to finally hear the cause. We thank the organizations and the people in this field while respecting their expertise,” she responded.
On Tuesday evening, Judge Chantal Massey ruled in favor of the lawyer of the Mobile Legal Clinic (CJI), which launched the request for stay last week.
“The uncomfortable equilibrium is conducive to partial and very objective discontinuation of the measure”, the judge ruled. She stressed that the safety and health of the homeless is at risk due to the current implementation of the curfew. It therefore, ordered that Article 29 of the Decree relating to persons traveling must be suspended until 5 pm on February 5 or until the case on merits is examined.
The decision of the Legalt government not to challenge this judgment and to amend the decree should also put an end to the legal debate in principle.
